By placing an order on this website, the customer fully accepts these Terms and Conditions of Sale.
2. Prices
All prices displayed on the website are expressed in Euros (€) and include French VAT where applicable.
Shipping costs are not included in the displayed prices and are automatically calculated during checkout according to the weight of the order and the selected shipping method.
Offers and prices are valid while stocks last.
3. Orders
Orders are considered final upon receipt of payment.
Unpaid orders are kept for seven (7) days. After this period, the items may be made available for sale again.
Undergroundtekno reserves the right to refuse or cancel any order for legitimate reasons.
4. Product Availability
Products are offered subject to availability.
In the event that a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible and the corresponding amount will be refunded.
Photographs and illustrations displayed on the website are non-contractual.
5. Packaging
Vinyl records are shipped in reinforced mailers specifically designed for vinyl record transportation in order to ensure optimum protection.
6. Shipping Address
The customer is solely responsible for the accuracy of the delivery information provided when placing an order.
The shipping information supplied by the customer is automatically transmitted to the carriers and used directly for generating shipping labels without any manual re-entry by Undergroundtekno.
It is the customer's responsibility to carefully verify their name, address, telephone number and any information necessary for proper delivery.
Undergroundtekno shall not be held liable for any consequences resulting from incomplete, inaccurate or outdated information provided by the customer.
7. Delivery
Orders are shipped to the address provided during checkout.
Delivery times communicated by carriers are indicative only.
Undergroundtekno shall not be held responsible for delays attributable to carriers.
Colissimo Without Signature
Parcels may be delivered directly to the recipient's mailbox.
This shipping method does not provide proof of delivery by signature. In the event of delivery to a mailbox, the possibilities of claims against the carrier may be limited.
Undergroundtekno recommends the Colissimo with Signature option for valuable orders or when the recipient's mailbox is not suitable for receiving parcels.
Colissimo with Signature
The parcel is delivered against the recipient's signature.
If the recipient is absent, the parcel may be made available at the local post office designated by the carrier.
Chronopost
Chronopost parcels are delivered according to the carrier's terms and conditions.
In case of absence, the parcel may be held at a depot or collection point.
Customers are advised to inspect the parcel upon delivery.
If visible damage is noticed, it is recommended to refuse the parcel and indicate the reason for refusal to the carrier.
Any anomaly must be reported to Undergroundtekno as soon as possible.
8. Damaged Parcels
As vinyl records are fragile products, customers are advised to inspect the parcel upon receipt.
In the event of significant damage to the parcel, customers are encouraged to refuse the shipment and immediately inform Undergroundtekno.
9. Vinyl Record Specificities
Vinyl records are analog media and the manufacturing process may result in certain variations or minor cosmetic imperfections that do not affect playback quality.
Minor surface marks, slight colour variations or very slight warping may occur and shall not be considered defects provided that normal playback is not affected.
Limited editions, vinyl colours, sleeves, stickers and other presentation elements may slightly differ from the images displayed on the website.
Audio samples and preview files are provided for informational purposes only and do not constitute contractual commitments.
10. Turntables, Cartridges and Playback Equipment
Vinyl playback may vary depending on the adjustment, condition and quality of the turntable, cartridge and stylus used.
A slight warp that does not affect playback on a properly adjusted turntable shall not be considered a product defect.
Undergroundtekno shall not be held responsible for playback issues resulting from improper setup, worn cartridges, worn styli or defective or unsuitable playback equipment.
11. Defective Products and Claims
Any claim regarding a defective product must be submitted to Undergroundtekno as soon as possible and, whenever possible, accompanied by photographs or videos showing the issue.
Undergroundtekno reserves the right to request the return of the product before issuing any replacement or refund.
No replacement or refund shall be granted for defects resulting from improper use or from defective or improperly adjusted playback equipment.
12. Right of Withdrawal
In accordance with the French Consumer Code, customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the order.
Returned products must be complete, in their original condition and properly protected.
Return shipping costs shall be borne by the customer.
Incomplete, damaged or deteriorated products will not be eligible for a refund.
13. Legal Warranty
Products sold by Undergroundtekno benefit from the legal warranty of conformity provided by Articles L.217-3 and following of the French Consumer Code, as well as the warranty against hidden defects provided by Articles 1641 and following of the French Civil Code.
14. Unclaimed Parcels and Returns to Sender
In the event that a parcel is returned to Undergroundtekno due to:

an incomplete or incorrect address;

the absence of the recipient;
-
failure to collect the parcel within the time limit set by the carrier;

or any other reason attributable to the customer,
the reshipping costs shall be borne by the customer.
The customer may choose between:

a new shipment at their own expense; or
-
a refund of the returned products, minus the original shipping costs and any expenses incurred by Undergroundtekno.
Original shipping costs are non-refundable.
15. Force Majeure
Undergroundtekno shall not be held liable for any total or partial failure to perform its obligations resulting from circumstances beyond its reasonable control and constituting a force majeure event under French law.

Customer information is treated confidentially.
In accordance with applicable regulations, customers have the right to access, rectify, object to and request the deletion of their personal data.

19. Governing Law
These Terms and Conditions of Sale shall be governed by and construed in accordance with French law.
Any dispute relating to the interpretation or execution of these Terms and Conditions shall be subject to the jurisdiction of the competent French courts in accordance with applicable legal provisions.
